When to use a lease agreement

Use one for any residential rental, whether a whole house, an apartment, or a single room. Even renting to someone you know is smoother with a written lease: it fixes the rent, the term, and the deposit rules, and gives both sides something to point to if a question comes up months later.

Rent, due dates, and late fees

State the monthly rent, the day it is due, and how it is paid. A late-fee clause with a short grace period encourages on-time payment while staying fair. Be aware that some places cap late fees, so keep yours within local limits.

Security deposits done right

Set the deposit amount, when it is paid, and when and how it is returned. Many states cap the deposit and set a deadline to return it with an itemized list of deductions. This template leaves room for lawful deductions for damage or unpaid rent while protecting the tenant’s money.

Who pays for what

Spell out which utilities the tenant covers and which the landlord covers, and set out maintenance responsibilities. Tenants generally keep the place clean and report problems; landlords keep it habitable and handle major repairs. Being explicit here heads off the most common day-to-day disputes.

Fixed term or month-to-month

A fixed-term lease locks in the rent and the tenancy for a set period; month-to-month is more flexible but easier to end. Choose the one that suits the arrangement, and set any renewal or holdover terms so the end of the term is not a surprise.

Residential tenancy law varies a lot by state and city, covering deposits, notice periods, entry rights, and required disclosures.
